उत्तराखंड पंचायत चुनाव पर संकट! हाईकोर्ट के आदेश से उलझा मामला, बड़ा सवाल?जब नियम नहीं तो शहरी मतदाता पंचायतों की सूची में कैसे? असमंजस्य की स्थिति में निर्वाचन आयोग।
हाईकोर्ट ने ऐसे प्रत्याशियों के पंचायत चुनाव लड़ने पर रोक लगा दी है जिनके नाम स्थानीय नगर निकाय और ग्राम पंचायत दोनों जगहों की मतदाता सूचियों में दर्ज हैं। कोर्ट ने स्पष्ट किया है कि दो मतदाता सूचियों में नाम वाले प्रत्याशियों का चुनाव लड़ना पंचायत राज अधिनियम के विरुद्ध है।
देहरादून: उत्तराखंड पंचायत चुनाव को लेकर नैनीताल हाईकोर्ट के एक फैसले ने राज्य निर्वाचन आयोग को मुश्किल में डाल दिया है। राज्य निर्वाचन आयोग के अधिकारियों ने नई मुसीबत से बाहर निकलने के लिए शनिवार को बैठक भी, लेकिन उसमें भी कोई हल नहीं निकल सका. आइए आपको बताते है। राज्य निर्वाचन आयोग के सामने पंचायत चुनाव को लेकर कोई सी नहीं चुनौती खड़ी हो गई है।
दरअसल, पंचायत चुनाव में वोटर और प्रत्याशियों को लेकर उत्तराखंड हाईकोर्ट में जनहित याचिका दायर की गई थी। याचिकाकर्ता का कहना था कि कुछ वोटर और प्रत्याशी है, जिनका नाम निकाय और पंचायत दोनों ही लिस्ट में है। कई तो ऐसे है, जिन्होंने निकाय चुनाव में वोट में भी किया है। जबकि नियम अनुसार कोई भी व्यक्ति दो जगहों पर वोट नहीं कर सकता है. इस मामले में उत्तराखंड हाईकोर्ट ने राज्य निर्वाचन आयोग से जवाब मांगा था।
राज्य निर्वाचन आयोग ने उत्तराखंड हाईकोर्ट को बताया था कि उन्होंने तमाम जिलाधिकारियों को सर्कुलर जारी किया था, जिसमें उन्होंने इस मामले डीएम की राय मांगी थी, लेकिन डीएम की तरफ से उन्हें अभी तक कोई स्पष्ट जवाब नहीं मिला है. इसके बाद उत्तराखंड हाईकोर्ट ने राज्य निर्वाचन आयोग के सर्कुलर पर रोक लगाते हुए साफ किया था। कि एक व्यक्ति एक ही जगह से वोट व चुनाव लड़ सकता है। साथ ही कोर्ट का यह भी मानना है कि किसी उम्मीदवार व वोटर को वोट देने से वंचित नहीं किया जा सकता, यह उसका संवैधानिक अधिकार है।
अब राज्य निर्वाचन आयोग के सामने समस्या यहीं है कि वो उत्तराखंड हाईकोर्ट के इस आदेश का पालन कैसे कराए. क्योंकि प्रत्याशियों के आवेदन निरस्त करने के साथ ही नाम वापसी भी तारीख भी निकल चुकी है. वहीं 14 जुलाई को प्रत्याशियों के चुनाव चिन्ह भी जारी होने है. इतने कम समय में ऐसे वोटर और प्रत्याशी के नाम का पता लगाना जिनका नाम निकाय और पंचायत दोनों लिस्ट में हो आसान नहीं है।

12 जुलाई को इस मसले पर राज्य निर्वाचन आयोग की बैठक भी हुई थी, लेकिन आयोग किसी नतीजे पर नहीं पहुंच पाया. वैसे उम्मीद की जा रही है कि 13 जुलाई रविवार को भी राज्य निर्वाचन आयोग इस मामले पर फिर से बैठक करेंगा और कोई बीच का रास्ता निकालेगा, ताकि उत्तराखंड हाईकोर्ट के आदेशों का पालन करते हुए पंचायत चुनाव कराए जा सके।
बड़ा सवाल यही उठ रहा है कि जिन प्रत्याशियों का नाम निकाय और पंचायत दोनों की वोटर लिस्ट में है, उनका क्या होगा? इसके साथ ही ऐसे व्यक्तियों का चयन करना भी निर्वाचन आयोग के लिए एक बड़ी चुनौती होगी?

उत्तराखंड पंचायती राज अधिनियम, 2016 के प्रावधान को दरकिनार करते हुए निकायों में शामिल मतदाताओं को पंचायतों में मतदाता बनाने पर सवाल भी खड़े हो रहे हैं। इसकी जांच की मांग की जा रही है कि आखिर अधिनियम में प्रावधान न होने के बावजूद पंचायतों की सूची में ये शहरी मतदाता कैसे आ गए।
दरअसल, उत्तराखंड पंचायती राज अधिनियम 2016 की धारा-9 की उपधारा-6 के तहत कोई भी व्यक्ति एक से अधिक क्षेत्रीय निर्वाचन क्षेत्रों की वोटर लिस्ट में नाम नहीं रख सकता। उपधारा-7 में ये स्पष्ट किया गया है कि अगर किसी व्यक्ति का नाम पहले से किसी अन्य नगर निगम, नगर पालिका या नगर पंचायत की मतदाता सूची में है, तो उसे नया नामांकन तभी मिलेगा जब वह दिखाए कि उस मतदाता सूची से उसका नाम हटा दिया गया है। लेकिन खुलेआम मतदाता बनाने वालों ने इस अधिनियम का उल्लंघन किया है।

आयोग के इस पत्र से बढ़ा असमंजस
राज्य निर्वाचन आयोग ने इस मामले में एक सर्कुलर जारी किया था। इसमें बताया गया था कि पंचायती राज अधिनियम की धारा 9(13) के अनुसार, ऐसा व्यक्ति जिसका नाम ग्राम पंचायत के किसी निर्वाचन क्षेत्र की मतदाता सूची में शामिल हो, उस ग्राम पंचायत में वोट देने और किसी भी पद पर चुनाव लड़ने, नामांकन करने, नियुक्ति का पात्र होगा।
इसी प्रकार, प्रावधान क्षेत्र पंचायत के लिए धारा 54(3) और जिला पंचायत के लिए धारा 91(3) में दिए गए हैं। इस सर्कुलर के जारी होने के बाद असमंजस बढ़ गया। आयोग का स्पष्ट रुख था कि जो मतदाता सूची में शामिल हो चुका, वह मतदान व चुनाव लड़ने का अधिकारी है जबकि नाम गलत तरीके से शामिल कराने वालों को लेकर आयोग ने कोई स्पष्ट रुख नहीं दिखाया। लिहाजा, हाईकोर्ट ने आयोग के इस सर्कुलर पर रोक लगा दी है।

अब सर्कुलर पर तो रोक लगी लेकिन आगे क्या होगा?
सवाल ये भी है कि हाईकोर्ट ने चुनाव प्रक्रिया में कोई हस्तक्षेप नहीं किया है। केवल चुनाव लड़ने संबंधी सर्कुलर पर रोक लगाई है। लिहाजा, जो लोग नामांकन कर चुके हैं, उनका क्या होगा। निर्वाचन आयोग की अधिसूचना के हिसाब से नामांकन, नामांकन पत्रों की जांच के बाद नाम वापसी की प्रक्रिया भी पूरी हो चुकी है। ऐसे में अधिसूचना में संशोधन न किया गया तो दो जगह नाम शामिल वाले प्रत्याशियों का क्या होगा? आयोग सचिव राहुल गोयल का कहना है कि हाईकोर्ट का आदेश मिलने के बाद ही इस पर स्पष्ट बात की जा सकेगी।
